In Spain it is extremely important to always be aware the one-year limitation period for all sorts of claims.
Let me give you an example of the limitation period:
A client and good friend of mine owns a house which is part of a “house-owners Association”.
The mentioned association commissioned work that caused damage to my client totalling €30,000. My client then contacted the president of the community who assured him that the community would pay for the damage.
After being put off by the president for two years, the client came to our office and described the case to us.
Unfortunately, we had to tell him that the case had already surpassed the limitation period of one year, as there was no proof of communication between him and the president that would have interrupted the limitation period.
(Fortunately, we still managed to get the compensation in the end. However, it would have been much easier to apply for compensation in the first year and get it paid.
So, what do we learn from this?
Always observe the one-year limitation period and always approach such matters in writing, because written communication or proof of communication between the parties interrupts the limitation period for damages.
